Council wins at Court of Appeal
Welwyn Hatfield Borough council successfully defended a strike out of a county court appeal, brought by solicitors Duncan Lewis to challenge a homelessness review decision.
Duncan Lewis raised the appeal on the grounds of a technicality based on the legal process and timeframe decisions can be reviewed.
The court dismissed the appeal, ruling that Welwyn Hatfield Borough Council, represented by Cornerstone Barristers, acted lawfully and upheld the original county court decision.
The appeal was heard before LJJ McCombe and Peter Jackson and Mrs Justice Roberts at a remote hearing on 13 October 2020.
