Welwyn Hatfield Local Plan faces legal challenge

The Welwyn Hatfield Local Plan faces a potential legal challenge, following the decision to adopt the plan at a full Council meeting on 12th October 2023.

The Council has been notified that Aurora Properties, a private developer, has applied to the High Court for a statutory review (under s.113 of the Planning and Compulsory Purchase Act 2004) in respect of the adoption of the Local Plan.

The Council will be reviewing the application and will not make further comment during proceedings.

Cllr Jane Quinton, Executive Member for Planning and Regeneration, said:

It is disappointing that after a six-year examination and a vote to adopt the plan at Full Council, the process could now be dragged out further, causing additional expense and delay for the taxpayers of Welwyn Hatfield. Having a sound plan in place provides an important platform for us to move forward, and I have asked Officers to review the High Court submission. In the meantime policies in the plan will continue to be used.
